1. Acceptance of Terms

By accessing and using the Pawsome Smile website, booking our services, or engaging with our mobile pet dental cleaning services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you ("Client," "you," or "your") and Pawsome Smile LLC ("Company," "we," "us," or "our"), a limited liability company registered in the State of Florida. By completing a booking or accepting our services, you acknowledge that you have read, understood, and agree to comply with these Terms.

2. Description of Services

Pawsome Smile provides mobile, anesthesia-free dental cleaning services for dogs and cats throughout Florida. Our services include:

• Professional anesthesia-free dental cleaning
• Mobile service delivered to your home
• Before and after photography
• Dental health assessment and recommendations
• At-home care guidance

Important: Our services are preventive maintenance and cosmetic in nature. We are not a replacement for veterinary dental care. We do not perform surgical procedures, extractions, or treatment of dental diseases. If we identify serious dental issues during cleaning, we will recommend you consult with a licensed veterinarian.

3. Booking & Appointments

3.1 Booking Process

Appointments can be booked online through our website or by phone. All bookings require advance payment to secure your appointment slot.

3.2 Appointment Confirmation

You will receive email confirmation upon successful booking. We will send reminder notifications 24-48 hours before your scheduled appointment.

3.3 Rescheduling

Appointments may be rescheduled with at least 24 hours notice at no additional charge. Requests to reschedule with less than 24 hours notice are subject to availability and may incur a rescheduling fee.

4. Cancellation & Refund Policy

4.1 Full Refund

• Cancellations made 24+ hours before appointment: Full refund
• Service cancelled by Pawsome Smile: Full refund
• Weather-related cancellations initiated by us: Full refund or reschedule

4.2 No Refund

• Cancellations made less than 24 hours before appointment
• No-shows (failure to be present at scheduled time)
• Service cannot be completed due to pet's behavior or health conditions not disclosed during booking

4.3 Partial Refund

If service is partially completed and must be stopped due to unforeseen circumstances, a prorated refund may be issued at our discretion based on services rendered.

5. Payment Terms

Payment is required at the time of booking to secure your appointment. We accept major credit cards and digital payment methods. All prices are in USD and include mobile service delivery within our standard service area.

Pricing: Our pricing is based on pet size and weight. Clients are responsible for providing accurate information about their pet's weight during booking. If actual weight differs significantly from reported weight, pricing adjustments may apply.

Additional Fees: Services outside our standard service area may incur additional travel fees. Multi-pet discounts are available and applied automatically during booking.

6. Service Limitations & Disclaimers

6.1 Not Veterinary Care

Pawsome Smile technicians are not licensed veterinarians. Our services are limited to cosmetic cleaning and preventive maintenance. We cannot diagnose, treat, or prescribe medication for dental diseases or other health conditions.

6.2 Service Refusal

We reserve the right to refuse or discontinue service if:

• The pet displays aggressive behavior that poses safety risks
• The pet shows signs of illness or distress
• Disclosed health conditions make service unsafe
• Environmental conditions are unsafe for technician or pet

6.3 Results Disclaimer

While we strive for excellent results, outcomes may vary based on the severity of buildup, pet cooperation, and individual oral health conditions. We do not guarantee specific results or the prevention of future dental problems.

7. Limitation of Liability

To the fullest extent permitted by law, Pawsome Smile shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services, including but not limited to:

• Pet injury or death not caused by our negligence
• Pre-existing health conditions that become apparent during or after service
• Property damage not directly caused by our technicians
• Lost profits, data, or business opportunities

Maximum Liability: In no event shall our total liability exceed the amount paid by you for the specific service giving rise to the claim.

Insurance: Pawsome Smile maintains liability insurance. However, clients are encouraged to maintain their own pet insurance to cover unforeseen health issues.

8. Pet Health & Safety

8.1 Client Responsibilities

You are responsible for:

• Disclosing all known health conditions, medications, and behavioral issues
• Ensuring your pet is current on required vaccinations
• Informing us of any allergies or sensitivities
• Providing a safe working environment for our technicians
• Supervising children and other pets during the appointment

8.2 Health Conditions

Certain health conditions may require veterinary approval before service. Please consult your veterinarian if your pet has:

• Heart disease or cardiac conditions
• Severe dental disease requiring extraction
• Recent surgery or medical procedures
• Compromised immune system
• Aggressive behavior history

9. Intellectual Property

All content on the Pawsome Smile website, including text, graphics, logos, images, and software, is the property of Pawsome Smile and protected by copyright and trademark laws.

Photo/Video Usage: By booking our services, you grant Pawsome Smile permission to photograph your pet before, during, and after the cleaning process. We may use these images for:

• Documentation and quality assurance
• Marketing and promotional materials
• Social media and website content
• Educational purposes

We will not share your personal information (name, address, contact details) publicly without explicit consent. If you do not wish for your pet's images to be used for marketing purposes, please notify us in writing.

10. Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our services, you consent to the collection and use of information as described in our Privacy Policy.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

Material changes will be communicated via email to registered users. We encourage you to review these Terms periodically.

12. Governing Law & Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

12.2 Dispute Resolution

In the event of any dispute arising from these Terms or our services, both parties agree to first attempt resolution through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with Florida law.

12.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive your right to participate in class action lawsuits or class-wide arbitration.
